- These Terms set out the rules for:
- using the Shop and its electronic services,
- entering into and performing contracts for training courses (in person, live online and recorded),
- selling products, including cosmeceuticals and cosmetic, aesthetic and medical devices,
- providing consultancy services.
- These Terms are made available free of charge before a contract is concluded, in a form that allows them to be downloaded, saved and printed.
§ 2. Definitions
- Customer – a natural person, legal person or organisational unit with legal capacity that uses the Shop or concludes a contract with the Seller.
- Consumer – a natural person concluding a contract not directly related to their business or profession.
- Sole trader with consumer rights – a natural person running a sole proprietorship who concludes a contract directly related to their business, where the contract is not of a professional nature for them, as determined by the business activities listed in the Polish business register (CEIDG). Under Polish law, such a person has the rights described in § 7 and § 8 to the extent provided by law.
- Course – a training service provided by the Seller:
- in person – at the place and on the date stated in the course description,
- live online – on the date stated, via an online platform,
- recorded (e-learning) – as digital content available for a set period.
- Participant – the person named in the order as attending the Course (the Customer or another person they nominate).
- Product – an item offered in the Shop, in particular cosmeceuticals, professional products, and devices and equipment.
- Medical device – a medical device within the meaning of Regulation (EU) 2017/745 (MDR).
- Aesthetic device – a device without an intended medical purpose covered by Annex XVI of the MDR (e.g. high-intensity electromagnetic radiation equipment such as lasers and IPL), or a cosmetic device that is not a medical device.
- Consultancy service – advice from SyneViaMed on choosing technologies, devices or treatment protocols, or on building a treatment menu, priced individually.
§ 3. Electronic services
- The Seller provides the following electronic services free of charge: Customer Account, order form, contact form, newsletter (with consent) and wishlist.
- To use the Shop you need an internet-connected device, an up-to-date web browser with cookies and JavaScript enabled, and an active email address.
- Customers must not submit unlawful content or take any action that disrupts the Shop.
- The Account agreement is concluded for an indefinite period. You can terminate it at any time by deleting your Account or emailing the Seller. You can unsubscribe from the newsletter at any time using the link in each email.
- Complaints about electronic services can be sent to the Seller's email address. The Seller will respond within 14 days.
§ 4. Contracts, prices and payment
- Information in the Shop is an invitation to make an offer, not an offer within the meaning of the Polish Civil Code.
- The Customer places an order using the Shop's order form. The contract is concluded when the Customer receives an email confirming acceptance of the order. That email, together with these Terms, records the content of the contract.
- Prices are shown in Polish złoty (PLN) or euro (EUR) and include VAT. Before placing an order, the Customer sees the total price, including any delivery costs.
- Whenever a price is reduced, the Seller shows the lowest price of the Product or Course in the 30 days before the reduction.
- The payment methods currently available are shown in the basket before the order is placed. They may include bank transfer to the Seller's account, instant online payments and payment cards handled by external payment providers, payment on delivery (cash on delivery or cash on personal collection) and, for business customers, online leasing. Buying in instalments or through leasing requires a separate agreement with the financing provider.
- Courses are paid in full in advance. Payment is due within 3 business days of the contract being concluded, unless the course description states otherwise. If payment is not received on time, the place is not reserved; the Seller will inform the Customer and may withdraw from the contract.
- The Seller issues a VAT invoice on request. The Customer agrees to receive invoices electronically.
- The Seller may provide information about the possibility of applying for external funding for courses or device purchases. Such information does not guarantee that funding will be granted. The detailed conditions are set by the funding body in each case.
§ 5. Courses – specific rules
- Participant requirements. Each course description states the target group and required qualifications (e.g. a degree in cosmetology or physiotherapy, or a licence to practise medicine). Courses in procedures reserved for doctors (including injections of medicinal products) are open only to physicians and dentists.
- The Seller may ask for a document confirming the Participant's qualifications. If the Participant does not meet the requirements, the Seller may refuse participation in the practical part or the entire Course and will refund the full amount paid, unless the Customer chooses another suitable Course.
- Certificate. On completing a Course, the Participant receives a SyneViaMed certificate or certificate of attendance. It confirms participation in the Course and the scope of knowledge gained. It does not confer professional qualifications or entitle the holder to perform activities that the law reserves for specific professions (in particular for doctors).
- After the Course, the Participant is responsible for performing treatments in line with their own qualifications, applicable law and the device and product manufacturers' instructions.
- Safety during practical sessions. Participants must follow the trainer's instructions and health and safety rules, and must disclose any health contraindications if they are to receive a treatment themselves. The trainer may exclude anyone who poses a risk to themselves or others from practical exercises.
- Changes by the Seller. The Seller may cancel or reschedule a Course for valid reasons (e.g. trainer illness, insufficient participants, force majeure), informing the Customer promptly – and, in the case of insufficient participants, no later than 7 days before the start date. The Customer may then choose a new date or receive a full refund within 14 days.
- Changes by the Customer. Free of charge, the Customer may:
- nominate a different Participant who meets the requirements in point 1 – no later than the day before the Course,
- transfer once to another date of the same Course – no later than 3 days before the Course, subject to availability.
- Cancelling a Course. In addition to the statutory right of withdrawal described in § 7, the Customer may cancel a Course by email to the Seller:
- 14 days or more before the Course – 100% refund,
- 13 to 3 days before the Course – 50% refund or a free transfer to another date,
- 2 days or less before the Course, or non-attendance – no refund; the Customer may still send another person in their place (point 7.1).
- Refunds are made within 14 days of receiving the cancellation. Where a Consumer still has a statutory right of withdrawal, the more favourable rules in § 7 apply.
- Online courses. Access links or platform logins are sent to the Customer's email address. Recorded courses are available for the period stated in the description. Access is personal and may not be shared with others.
- Copyright. Course materials (presentations, handouts, recordings, treatment protocols) are protected by copyright. Participants may use them only for their own professional purposes. Copying, distributing or recording Courses without the Seller's written consent is prohibited.
- Image rights. The Seller uses photos or videos showing a Participant only with their separate, voluntary consent, which may be withdrawn at any time.
- Models. Models may take part in practical sessions by receiving training treatments. Before any treatment, each model completes a health questionnaire and an eligibility assessment carried out by the trainer, and gives written consent to the treatment and to the processing of their health data. The trainer may decline to perform a treatment if there are contraindications.
§ 6. Products, devices and delivery
- Products are delivered within Poland using the methods shown in the basket (including InPost parcel lockers and courier, DPD, DHL and Poczta Polska) or can be collected in person. Deliveries outside Poland are arranged individually. Delivery time and cost are shown before the order is placed.
- Medical devices are sold only to entities and persons authorised to use them. The Seller may ask for documents confirming such authorisation before processing an order.
- Each device is supplied with the documents required by law, in particular instructions for use, manufacturer details and CE marking, and – for medical devices and Annex XVI MDR devices – documents compliant with the MDR. The EU declaration of conformity is available on request.
- The Customer undertakes to use each device in line with its intended purpose and the manufacturer's instructions, by suitably qualified and trained staff.
- Made-to-order devices – devices built or configured to the Customer's individual specification – are supplied under a separately agreed quotation stating the specification, price, lead time and payment terms.
- Cosmeceuticals and professional products labelled "for professional use" are intended for specialists and must be used as described on the product and its label.
- Product safety information required by Regulation (EU) 2023/988 (GPSR) – manufacturer, contact details and warnings – is shown on each Product page.
§ 7. Right of withdrawal (Consumers and sole traders with consumer rights)
- A Consumer may withdraw from a distance contract without giving a reason within 14 days:
- for Courses and services – from the day the contract is concluded,
- for Products – from the day the Consumer (or a third party other than the carrier, indicated by the Consumer) takes possession of the Product.
- To withdraw, simply send a clear statement before the deadline, e.g. by email to the Seller. You may use the model form in Annex 1, but this is not mandatory.
- In-person and live online Courses. If a Course is scheduled to take place within 14 days of the contract being concluded, the Consumer must expressly request that the service begin before the withdrawal period ends (e.g. by ticking the relevant box in the order). If the Consumer withdraws after making such a request, they pay for the part of the service provided up to the time of withdrawal, in proportion to the full service. The right of withdrawal does not apply once the Seller has fully performed the service with the Consumer's express consent, given after the Consumer was informed before the start that they would lose the right of withdrawal once the service was fully performed, and acknowledged this.
- Recorded courses (digital content). The right of withdrawal does not apply if supply (access to the recording) began with the Consumer's prior express consent before the withdrawal period ended, after they were informed that they would lose the right of withdrawal, and the Seller provided them with confirmation.
- The right of withdrawal also does not apply, among others, to:
- Products supplied in sealed packaging that cannot be returned for health protection or hygiene reasons once unsealed (e.g. cosmeceuticals, ampoules), if the packaging was opened after delivery,
- Products made to the Consumer's specifications or clearly personalised (e.g. made-to-order devices).
- The Seller refunds all payments, including the cost of the cheapest standard delivery method, within 14 days of receiving the withdrawal statement, using the same payment method unless the Consumer agrees otherwise. For Products, the Seller may withhold the refund until it receives the Product or proof that it has been sent back.
- The Consumer must return the Product within 14 days of withdrawal and bears the direct cost of returning it. The Consumer is liable for any reduction in value resulting from handling the Product beyond what is necessary to establish its nature, characteristics and functioning.
- This section also applies to sole traders with consumer rights.
§ 8. Non-conformity and complaints
- Consumers and sole traders with consumer rights. The Seller is liable for the conformity of Products, Courses and digital content with the contract under the Polish Consumer Rights Act. The Seller is liable for any lack of conformity of a Product that becomes apparent within 2 years of delivery. The Consumer may request repair or replacement and, in the cases set out in the Act, a price reduction or withdrawal from the contract.
- Other business customers (B2B). The Seller's liability under statutory warranty (rękojmia) is excluded (Art. 558 § 1 of the Polish Civil Code), without prejudice to any manufacturer's guarantee. The Seller's liability is limited to the price paid and excludes lost profits, to the extent permitted by law.
- Any manufacturer's guarantee does not exclude or limit the Consumer's statutory rights.
- Complaints can be sent to the Seller's email or postal address. Please include a description of the problem, your request and your contact details. The Seller will respond within 14 days.
§ 9. Out-of-court dispute resolution
- Consumers may use out-of-court complaint and redress procedures, including:
- applying to a permanent consumer arbitration court or to the Provincial Trade Inspectorate (for the Seller: WIIH in Gdańsk) for mediation,
- obtaining free help from a local consumer ombudsman or consumer organisations.
- Consumers from other EU countries can get help from the European Consumer Centre in their country.
- More information is available from the Polish Office of Competition and Consumer Protection (UOKiK): prawakonsumenta.uokik.gov.pl.
§ 10. Personal data
The Seller is the controller of personal data. Details are set out in the Privacy Policy.
§ 11. Final provisions
- Contracts are concluded in Polish, English or German, depending on the language version of the Shop chosen by the Customer.
- Contracts are governed by Polish law. This choice of law does not deprive Consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
- Disputes with Customers who are neither Consumers nor sole traders with consumer rights are resolved by the court with jurisdiction over the Seller's registered office.
- The Seller may amend these Terms for valid reasons (changes in law, payment or delivery methods, or the scope of services). Amendments do not affect contracts concluded before they take effect. Account holders will be notified by email at least 14 days in advance.
- These Terms apply from 13 October 2026.
